1. Data controller

The controller of your personal data is Interfell Corp, Basinside Court, Sanford, Florida 32771, USA (EIN 32-0547655). For any privacy question or request, write to legal@interfell.com.

Interfell Corp is part of a group that includes the following companies, which may take part in delivering our services and process your data for that purpose. When you contract with or deal directly with one of them, that company is also the controller of the data needed for that relationship:

Interfell operates together with Simera, a company in the same group.

2. Data we collect

2.1 Companies and prospective clients

When you request information, a quote or a call, or when you hire us:

• First and last name, company name, job title, work email and phone number.
• Country and city, and when you plan to hire.
• The profile or role you are looking for and the messages and comments you send us.
• Details of the opening: type of professional, required profession and technical skills, languages, work arrangement, estimated duration, required hours, estimated budget and start date.
• As a client: contract, billing and payment data.

We never publish company contact details or opening budgets on our platform.

2.2 Talent and candidates

When you create a profile or apply for an opening:

• Personal information: email address, password (stored in protected form), first and last name, phone number, date of birth, country and city of residence, and how you found Interfell.
• Professional information: area of expertise, primary and secondary technical skills and years of experience in each, other skills, current monthly income, expected monthly income, availability, work arrangement, English level, other languages and a link to your CV.

Your email, password, phone number, how you found us, current and expected income and your CV are never shown publicly on the platform. The rest of your profile may be shown to client companies so they can consider you for openings. When we put you forward for a specific opening, we share your profile and CV with that client company.

2.3 Browsing data and cookies

When you browse our websites we automatically collect technical data such as IP address, approximate location derived from it, device and browser type, pages visited, referring page, date and time of visit and how you interact with the site, using cookies and similar technologies (see section 10).

Please keep your data accurate and up to date. If you do not provide the data we need to deliver a service, we may not be able to provide it.

3. Purposes

• Respond to your enquiries, prepare proposals and schedule calls.
• Deliver our recruiting, remote staffing, talent sourcing and payroll services: find and assess candidates, present them to client companies, manage hiring processes, contracts and billing.
• Manage talent profiles and applications, and contact you about openings that match your profile.
• Send you newsletters, content and updates about our services; you can unsubscribe at any time from the link in each email.
• Measure and improve our websites and services, and measure our campaigns.
• Keep our systems secure and prevent fraud.
• Comply with our legal, tax and accounting obligations and defend our rights.

We do not sell your personal data.

4. Legal bases

• Consent: when you submit a form that asks for it, accept non-essential cookies or sign up to receive marketing communications. You can withdraw it at any time, without affecting processing carried out before you did.
• Pre-contractual steps and performance of a contract: to answer your request for information or a quote, deliver the contracted services and manage your application.
• Legitimate interest: to keep our websites secure, improve our services, send relevant B2B communications to professional contacts and defend claims, always balanced against your rights.
• Legal obligation: to meet tax, accounting, employment and other legal requirements.

5. Recipients and processors

We only share your data when necessary and with:

• Client companies: talent profiles, as described in section 2.2.
• Group companies: Interfellows SL, Interfell SAS and Simera, to deliver and manage our services.
• Service providers that process data on our behalf under a contract:
  • HubSpot, Inc. (USA): CRM, forms, email and hosting of our website.
  • Google LLC (Google Tag Manager and Google Analytics): website analytics.
  • Meta Platforms (Meta pixel): campaign measurement and advertising.
  • Hotjar Ltd.: analysis of how the website is used.
  • Supabase and Vercel: hosting of databases and applications.
  • Slack Technologies: internal team notifications.
• Authorities and courts, when required by law.
• Parties to a corporate transaction (merger, acquisition or sale of assets), subject to appropriate privacy safeguards.

Our websites may contain links to third-party sites. Your interactions with them are governed by their own privacy policies.

6. International transfers

Interfell Corp is a US company, so your data is processed and stored in the United States, and our providers and group companies may process it in other countries (for example, Spain or Colombia). When we transfer personal data from the European Economic Area, the United Kingdom or other countries with transfer restrictions, we rely on appropriate safeguards, such as the standard contractual clauses approved by the European Commission or, where the provider is certified, the EU-U.S. Data Privacy Framework. 7. Retention and security

We keep your data only for as long as needed for the purpose it was collected for:

• Prospective clients: while there is a commercial relationship or interest, and until you ask us to delete it.
• Clients: for the term of the contract and, afterwards, for the periods required by tax and commercial law.
• Talent: while your profile remains active or until you ask us to delete it.
• Marketing communications: until you unsubscribe.
• Cookies: for the period stated for each cookie.

We apply technical and organizational measures to protect your data: encrypted (SSL/TLS) connections, encrypted storage and access limited to authorized staff bound by confidentiality. No transmission over the internet is completely secure, so please take care with the information you send us by email.

8. Your rights

Depending on the law that applies to you, you have the right to:

• Access the personal data we hold about you.
• Rectify inaccurate or incomplete data.
• Erase your data.
• Object to processing, including for direct marketing.
• Restrict processing.
• Data portability.
• Withdraw your consent at any time.

To exercise them, email legal@interfell.com with the subject line "Privacy" and tell us which right you wish to exercise. We may ask you to verify your identity. We will reply within the time limits set by applicable law (one month under the GDPR, which may be extended in complex cases). You can also unsubscribe from our emails using the link included in each one.

Some rights may be limited, for example if a request would reveal personal data about another person, or if we must keep the information by law or for compelling legitimate reasons such as fraud prevention. We will not discriminate against you for exercising your rights.

9. Complaints to a supervisory authority

If you believe we have not handled your data properly, you can lodge a complaint with the competent authority: in Spain, the Spanish Data Protection Agency (AEPD, www.aepd.es); in another country, your local data protection authority (for example, Argentina's Agency for Access to Public Information, Colombia's Superintendence of Industry and Commerce or the competent authority in Mexico). We encourage you to contact us first so we can try to resolve it.

10. Cookies

We and our providers use cookies and similar technologies to:

• Make the website work (necessary cookies, such as the one that remembers your cookie preferences).
• Analyze its use (HubSpot, Google Analytics and Hotjar).
• Measure campaigns and show advertising (Meta pixel).

You can manage your preferences in the cookie banner and block or delete cookies in your browser settings; disabling some cookies may limit certain features. More details in the Cookie Policy tab of our Terms and Conditions.

11. Changes to this policy

We may update this policy when our services or the law change. We will publish the new version on this page with its update date and, if the changes are material, we will let you know by email or through the website.
