INTERFELL Corp. (“Interfell”) provides this Privacy Policy to inform you of our policies and procedures regarding the collection, use and disclosure of information through the web platform www.interfell.com (the “Site”) and any other website, feature, application, widget or online service owned or controlled by Interfell or its current or future affiliates (the “Service”), as well as any information Interfell collects offline in connection with the Service.

You are under no legal obligation to provide us with any information, but you do have a contractual obligation to do so. Therefore, if we do not receive certain information from you, we will not be able to provide you with our Service.

PLEASE READ THIS AGREEMENT CAREFULLY. THIS AGREEMENT GOVERNS YOUR USE OF THE SERVICE. IF YOU DO NOT ACCEPT THE TERMS OF THIS AGREEMENT OR ANY REVISED VERSION OF IT, DO NOT USE THE SERVICE.

INFORMATION SUBMITTED TO INTERFELL

1. INTERFELL, registered in the USA as INTERFELL CORP under EIN 32-0547655, through the operation of the site www.interfell.com (the “Web Platform”), collects and stores all the information shared by its users, keeping it confidential and private. That information will not be used for any purpose other than the employment or professional interests and connections described herein.
2. Those employment or professional interests and connections work as follows: a Company User posts an Opportunity or Opening on the Platform, with data and information relevant to the Profile it needs to hire for its company or project. A Talent User can then, through their professional skills, connect with that Opening by submitting an Application together with the professional data and information shared in THEIR PROFILE, so as to be considered in selection processes in which only the Company User has the authority to accept or reject, and to hire or not hire, that Talent User.
3. Accordingly, when using the Web Platform under our IT Talent Recruiting and Hiring services, you must be aware of the use you make of your personal and professional information and of the Openings you post. Your data and information will be treated as accurate, and will not be used for any other purpose without your consent.
4. In our models for a Company User to connect with Talent Users — a database of professional talent, pre-qualified CVs, or Openings, where a common interest in professional services can be transacted among all Users — we do not sell anything that specifically identifies an individual. In other words, we display the data you provide us as accurate so that a connection between the parties can be made and a hire can effectively take place.
5. In short, there are no client lists with data that has not been shared through their openings, no professional talent with data that has not been shared in their profiles, and no other information irrelevant to third parties that is processed outside the consent or approval of everyone involved. Therefore, anyone who posts or shares professional or employment information on the Web Platform accepts these Terms and Conditions so that connections and transactions in which everyone wins can happen with no extra or unvalidated data. Everything is real: the information you provide here.

LEGAL STANDARDS

Privacy standards differ depending on where in the world you are located. At Interfell, in order to provide robust protection for our users’ personal data regardless of where they live, we collect, store and use personal data in accordance with the requirements and standards of all applicable laws relating to the protection of personal data, including (but not limited to) the General Data Protection Regulation (GDPR) (EU) 2016/679; the California Online Privacy Protection Act; Argentina’s Personal Data Protection Law No. 25,326; Colombia’s Law No. 1581 on the Personal Data Protection Regime; Mexico’s Organic Law 15/1999; EU Regulation 2016/679; the EU ePrivacy Directive 2002/58/EC as amended by Directive 2009/136/EC, together with their amendments and any future replacements, and any implementing national legislation (the “Data Protection Laws”).

For the purposes of the Data Protection Laws, in relation to any personal data that you or any user submits to our platform, you will be the controller and owner of the data and we will be a processor of that personal data.

INFORMATION COLLECTED

The purpose of the Web Platform is to collect information and allow it to be used to deliver our IT Talent Recruiting and Hiring services, in order to find a solution to the requirements within our areas of expertise. The purpose is therefore to respond to your inquiries and requests, to create profiles, to post Openings and to process applications, with a view to identifying, authenticating, analyzing, proposing and delivering a quality service so that effective and successful hires happen through remote work. We will keep confidential any contact information you provide us, regardless of the channel through which it is collected, and it will be used only for the purposes for which it was collected (subject to the exclusions and disclosures mentioned in this Agreement), whereby you agree that we may disclose it on the Web Platform for the purpose of professional employment connections.

Four types of information may be collected and disclosed through the Web Platform: Talent Personal Information, Talent Professional Information, Company/Project Information and Opening Information.

The following Talent Personal Information is requested:

• Email address
• Private password
• Password confirmation
• First and last name
• Phone number
• Date of birth
• Country of residence
• City of residence
• How you found the Web Platform

Of that Talent Personal Information, the following will under no circumstances be displayed on the Platform: email address, password, phone number and how you found the Platform. The remaining data may be disclosed so that a Client User can take an interest in the Profile shown on the Platform.

The following Talent Professional Information is requested:

• Area of specialization
• Primary technical skill
• Experience in the primary skill
• Secondary technical skill
• Experience in the secondary skill
• Other skills
• Current monthly income
• Expected monthly income
• Schedule availability
• Work arrangement
• English level
• Knowledge of other languages
• Link to their CV

Of that Talent Professional Information, the following will under no circumstances be displayed on the Platform: current monthly income, expected monthly income and the link to their CV. The remaining data may be disclosed so that a Client User can take an interest in the Profile.

— ABOUT THE COMPANY USER

The following Company/Project Information is requested:

• First and last name
• Company name
• Phone number
• Email
• Country
• City
• How you found INTERFELL

None of the Company/Project Information listed or requested above will be displayed on the Platform under any circumstances.

The following Opening Information is requested:

• Type of professional you wish to hire
• Title of the Opening
• Profession required of the Talent
• Primary technical skill required
• Secondary technical skill required
• Languages the Talent must know
• Other skills required
• Additional information
• Work arrangement chosen
• Estimated duration of the engagement
• Working hours required
• Estimated budget for the hire
• Start date of the contract and activities

Of that Opening Information, the following will under no circumstances be displayed on the Platform: the estimated budget for the hire, and anything that would compromise the name of the Company/Project.

It is important that the personal data we hold about you is accurate and up to date. Please keep us informed if your personal data changes during your relationship with us. If you do not provide the personal data we need by law, or under the terms of a contract we have with you, and you do not provide that data when requested, we may not be able to perform the service we are trying to provide.

USE OF THE INFORMATION COLLECTED

Interfell will use your personal data only as permitted by law. The information may be used only by Interfell team members, in order to effectively connect a Company User’s Opening with the professional skills of a Talent User, matching all requirements.

In addition, any of the information we collect about you may be used in any of the following ways:

• To personalize your experience. Your information helps us respond better to your particular needs.
• To improve our website. We continuously strive to improve our website’s offerings based on the information and feedback you provide.
• To improve customer service. Your information helps us respond more effectively to your service inquiries and meet your needs.
• To process transactions. Your information, whether public or private, will not be sold, exchanged, transferred or given to any other company for any reason without your consent, except for the express purpose of delivering the requested service.
• To run a contest, promotion, survey or other site feature.
• To send periodic emails. The email address you provide may be used to send you information and updates, and you may occasionally receive company news, service information and similar communications.
• To comply with legal obligations. We need to use and disclose personal information in certain ways in order to meet our legal obligations.

USE OF THE DATABASE FOR SENDING INFORMATION

Once you register, your data goes into our database and is kept private and confidential. It may be used only to send you information directly from us, not from third parties. That information may relate to the data you submitted, to a mistake or error detected, to www.interfell.com policies, to required updates of the information submitted or of the Platform, to information of interest, or to items such as articles related to the world of work, the professional world and remote work; promotions; openings; and anything else concerning the use of the Platform and the purposes it promotes. That information will be sent from our official email channels or another means of contact, and you will be able to decide whether you wish to receive it or to unsubscribe.

DO WE DISCLOSE YOUR INFORMATION TO THIRD PARTIES?

We do not sell, trade or transfer your personally identifiable information to third parties. However, this does not include:

• Affiliates: We may share personal data with our current and future affiliates, that is, an entity that controls, is controlled by, or is under common control with the Company. Our affiliates may use the personal data we share in compliance with this Privacy Policy.
• Service providers: We may employ third-party companies and individuals to facilitate our Service, to provide the Service on our behalf, to perform Service-related services (including, without limitation, maintenance services, database management, web analytics and online advertising, payment processing and fraud detection), or to help us analyze how our Service is used. These third parties may have access to your personal information in order to perform these tasks on our behalf.
• Business transfer: If we are involved in a merger, acquisition, due diligence financing, reorganization, bankruptcy, receivership, sale of all or part of our assets, or transition of the service to another provider (collectively, a “Transaction”), your personal data and other information may be shared in the diligence process with counterparties and others assisting with the Transaction, and may be transferred to a successor or affiliate as part of that Transaction along with other assets. In such a case, we will make commercially reasonable efforts to help ensure that your personal information remains subject to appropriate privacy protections, in accordance with applicable privacy law.
• Redirection to third parties: The Interfell Service may also redirect to, and enable additional interactions with, a third-party website, service or other content. In that case, the third party may have access to information about you and your use of our services. Your interactions with third parties are governed by those third parties’ respective privacy policies.

DATA PROTECTION

We implement a range of security measures to keep your personal information protected whenever you enter, submit or access it.

We use a secure server. All sensitive information is transmitted using Secure Socket Layer (SSL) technology. It is then encrypted in our database so that only people with specific permissions to our systems can access it, and they are required to keep that information confidential.

After a transaction, your private financial information will be stored in our file for more than 60 days so that you can apply to each opening without re-entering the information.

Because we are a US company, we process and store your information in the United States, and our service providers may process and store it elsewhere. However, no transmission over the internet or by email is completely secure or error-free. In particular, email sent to or from us may not be secure. You should therefore take special care in deciding what information you send us through the Site or by email. Please keep this in mind when disclosing personal data over the internet. In addition, we are not responsible for the circumvention of any privacy settings or security measures contained in the Site or in third-party websites.

YOUR CHOICES AND RIGHTS

You have rights over how your personal data is handled. Specifically, you may:

• Request access to the personal data we hold about you.
• Request the correction of your personal data.
• Request the restriction of the processing of your personal data.
• Withdraw your consent at any time where we rely on consent to process your personal data. This will not, however, affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide you with certain products or services. If that is the case, we will tell you at the time you withdraw your consent.
• Request the temporary suspension of the use of your personal data.
• Request the permanent deletion of your personal data from our records. We will make commercially reasonable efforts to comply with your deletion requests; however, certain information may persist in the Service even if you close your account.

In addition, the rights described above may be limited — for example, if complying with your request would reveal personal information about another person, or if you ask us to delete information that we are required by law to keep or have compelling legitimate interests in keeping (for example, for fraud prevention purposes). Your personal information may remain in our files, and information you update or delete, or information within a closed account, may persist internally for our administrative purposes to the extent permitted by law. We will also normally not delete information you have posted publicly through or on the Service.

Please note that neither you nor Interfell can delete every copy of information that has previously been shared with others on the Service. We will not discriminate against you for exercising any of your rights relating to the access, modification or deletion of your personal information. If you wish to exercise any of the rights set out above, follow the request instructions provided on the Interfell website.

CHANGES

The Service and our business may change from time to time. As a result, we may change this Privacy Policy at any time. When we do, we will post an updated version on this page, unless applicable law requires another form of notice. If you continue to use our Service, we will notify you at your registered email address or by other means, where appropriate.
