No permanent establishment

Hire in Latin America without setting up a local entity.

Interfell signs the contract, issues the invoices and pays in the right country. Your company opens nothing abroad, registers nowhere and receives one consolidated invoice a month.

The real concern

The worry is never the talent. It is permanent establishment.

Almost every conversation with a US or European team starts the same way: does this force me to open something down there? The short answer is no. The long one is below.

What permanent establishment means

It is when a tax authority considers that your company operates in their country on a stable basis and therefore owes tax there. It typically triggers when your company hires directly, holds an office or someone signs contracts on its behalf.

Why staffing avoids it

Because the contractual relationship with the professional is not yours — it is ours. You are buying a service from a vendor, the same way you buy any other outsourced service.

Payroll and compliance, handled

Contracts, invoicing, payment in local currency and receipt collection in each country. You get one consolidated invoice a month with the detail per person.

The setup

How it is put together.

01 Master agreement

You sign once

A services agreement between your company and Interfell covering scope, rates and conditions. That document covers everyone you add later.

02 Per person

We sign locally

Services contract between Interfell and the professional, with NDA and IP assignment in your company's favour.

03 Month to month

We pay and collect

On-time payment in the right country, invoice and receipt collection for both sides.

04 When needed

Add, remove, change

Adding or removing someone does not reopen the master agreement. It is handled as a scope change.

Honest comparison

FAQ

What teams ask us most.

Does hiring this way create permanent establishment for my company?
Under the staffing model your company buys a service from Interfell, not from the individual. The contractual relationship with the professional is ours and is signed in their country. That said, every case depends on how your company operates and on the applicable tax treaty: we review it with you on the first call and we are happy to send the contract to your tax advisor.
How does payroll and compliance work across Latin America?
Interfell handles the contract, the local invoicing, the monthly payment in the right country and the collection of receipts. You receive a single consolidated invoice with the detail per person, so your finance team deals with one vendor instead of one transfer per country.
Who owns the intellectual property of the work?
Your company. It is covered both in the contract between Interfell and the professional and in the master agreement with you.
Can we scale a product team without setting up local entities?
Yes — that is the point of the model. You add people under the same master agreement regardless of which country they are in, and remove them with the agreed notice period, without opening or closing anything abroad.
What happens if we want to offboard someone?
It is handled as a scope change to the master agreement, with the agreed notice. There is no need to reopen the contract or run a legal process in that country.
Can we hire the person directly later on?
Yes, and it is a common and welcome outcome. We discuss moving them onto your entity when it makes sense for both sides.

Want to check it against your case?

A 20-minute first call. We tell you which structure fits and which does not — even if the answer is that it is not us.
